Waiver and Release
Training Acknowledgement
I have enrolled myself or my child in a program of strenuous physical activity including, but not limited to, a variety of indoor/outdoor training sessions (the “Sessions”), including weight training and various aerobic activities offered by Ross Oberlin and RC Training & Fitness (“RCTF”). By signing this waiver, I certify that I or my child am in good health and physical condition and do not suffer from any disability which would prevent or limit my participation in the sessions. I agree to abide by any decision of RCTF, including its members, successors, employees, organizers, representatives, agents, and officers (individually and collectively, the “RCTF Parties”) regarding my ability or my child’s ability to safely complete and participate in the sessions. I fully understand that injury may occur as a result of participation in the Sessions including, but not limited to, miscarriage, heart attack, muscle strains or tears, ligament sprains or tears, broken bones, heat exhaustion or heat stroke, and joint injuries. This also includes any negligence associated with the presence of or transmission of any bacteria, viruses, or infectious diseases. I understand that some components of training sessions may require a certain level of appropriate hands-on contact. I will immediately and verbally notify the trainer if I or my child at any point become uncomfortable. I acknowledge that training fees are non-refundable and nontransferable for any reason.
Risk Acknowledgement, Indemnity, and Release
In consideration of my participation in these Sessions, I hereby assume all risks, known and unknown, associated with participation in the sessions including, but not limited to, any injuries resulting from falls, contact with other participants, and the conditions of training sites, bodily injuries and death. To the fullest extent permitted by law, I hereby agree to indemnify, hold harmless and defend the RCTF Parties from and against any and all claims, losses, damages, expenses and other liabilities (including, but not limited to, court costs and attorney’s fees) arising out of or resulting in whole or in part from my participation in the Sessions. I for myself and anyone entitled to act on my behalf, including, but not limited to my heirs, executors, agents, administrators, assigns and successors, hereby RELEASE, WAIVE AND FOREVER DISCHARGE the RCTF Parties from any and all claims, losses, damages, expenses and other liabilities of any kind arising out of my participation in the sessions even if such claims, losses, damages, expenses and other liabilities arise out of negligence or carelessness on the part of any or all of the of the RCTF Parties.
Media Release
I hereby grant and convey to the RCTF Parties all right, title and interest I may have in any and all photographs, motion pictures, video recordings, and any other recordings made during or about the sessions, and the RCTF Parties shall have the right to exploit such recordings throughout the universe, an unlimited number of times, in perpetuity by any and all means and media, now known or hereafter invented.
Medical Emergencies
If a medical emergency involving me occurs during a session, I understand that the RCTF Parties will attempt to contact my emergency contact listed below. If that person cannot be reached or time does not permit, I hereby give permission to the RCTF Parties to contact emergency services for help, and give permission to a licensed physician or other licensed medical provider to provide proper treatment, including but not limited to hospitalization, injection, anesthesia and/or surgery. I hereby agree, for myself and my heirs, executors, agents, administrators, and/or assigns, to release, waive and forever discharge and release the RCTF Parties from any and all claims, liabilities, causes of action, damages, demands, judgments, executions, liens and costs whatsoever in law or equity, including, without limitation, liability for death or bodily injuries to any person or damage to any property resulting from any (i) claims made against medical providers of emergency services under this authorization, or (ii) against the RCTF Parties for obtaining emergency medical services for me pursuant to this authorization and waiver.
Other Activities & Referrals
Participants of RCTF programs are often encouraged to participate in activities, events, races and other group challenge activities which are run by independent third parties that are not affiliated with RCTF (the “Other Activities”). RCTF may refer you to a medical or other professional (“Professionals”). RCTF assumes no responsibility for any such Other Activities or Professionals and you agree that participation with such Other Activities or Professionals will be entirely at your own risk, and that you will indemnify, hold harmless and defend the RCTF Parties from and against any and all claims, losses, damages, expenses and other liabilities (including, but not limited to, court costs and attorney’s fees) arising out of or resulting in whole or in part from my participation with Other Activities and Professionals.
Payments
1-on-1 Training Sessions expire 4 months after the date of purchase.
Clients may pay with Debit or Credit Card.
Credit/Debit Card charges should show on bill as: “RC Training and Fitness”
For small group personal training, you may reschedule a session 3+ hour before the scheduled session without penalty. If you cancel within that timeframe, that will count as one of your sessions for the week unless you have made arrangements with your trainer.
If you arrive late, you will only receive the remaining scheduled time for your session. A “no-show” will be charged as a completed session. You are still expected to complete a full warm-up before training.
No refunds or transfers, unless RCTF cannot continue with your sessions.
RC Training & Fitness Membership Terms and Conditions
Your Kickstart Membership gives you 6 weeks to train with us! If you're not sold on RCTF within the first 6 weeks, you have zero obligation to continue.
Regular monthly pricing can be viewed at www.rc-fit.com/pricing. The Kickstart Membership gives you an opportunity to figure out what regular membership is right for you.
Because our gym is founded on customized programming and coaching, we start every new member with the Kickstart Membership and do not have regular monthly memberships available for purchase on the website. Instead, once you’ve decided which monthly membership you’d like, simply reply to abby@rc-fit.com and we’ll get everything set up for you.
To discontinue after your Kickstart membership, you must submit an email request to abby@rc- fit.com at least 7 days before the end of your kickstart term. We do not accept phone or in person requests.
Schedule your training sessions online. You may do this on our website or through the app. Simply go to https://www.rc-fit.com/schedule-1, or download the scheduling app (iOS available here and Android available here)
You may cancel/reschedule sessions through the website or the app as well. Please do not contact coaches to cancel/reschedule. Sessions are deducted if cancelled within 3 hr. of the start time unless you are cancelling due to emergency. In addition, you cannot book a training session within an hour of it starting.

Monthly Dues: How do I pay for my membership?
All member accounts are billed monthly. The specific date for that begins 6 weeks after your initial consult/assessment.
If we are unable to collect payment, you will receive an email to the account listed on your agreement. Once new billing information is given, you will be billed on that day for any past due amounts, but your billing date remains the same.
Any outstanding balance(s) must be paid in full prior to any cancellation, freeze or member change request being processed.
To avoid any penalty fees please make sure that we have a valid email and phone number on file for you so that we may contact you in the event that your dues are unable to be collected.

Membership Plans: How long will my membership last?
Your membership will auto-renew monthly unless you decide to discontinue. IF YOU MISS DAYS your sessions can roll over from month to month, but they DO NOT delay payment. They only roll over for as long as you are a member of RC Training & Fitness, LLC. To roll over sessions, you must email abby@rc-fit.com.
Please remember that all changes/requests must be sent to us at least 30 days prior to your next billing date. Any request received after will be processed for the following billing cycle.
Freeze Requests: Can I put my membership on hold?
A member must give RC Training & Fitness, LLC written notice at least 7 days prior to their billing date/month which they would like to freeze.
Freezes are done for the entire billing month.
Each membership may be frozen for a maximum of three months per calendar year, unless other agreement(s) is/are made between member and RC Training & Fitness, LLC.
Frozen months do not need to be consecutive.
After the freeze period ends, the membership will be automatically reactivated with dues drawn from your account as before the freeze.
Telephone or verbal requests are not accepted. When you notify RC Training & Fitness, LLC via email (abby@rc-fit.com), you will receive a confirmation of your request. If you do not receive a response, we have not received your request.
Cancellation Requests: Can I terminate my membership?
Yes, you have 6 weeks to try us out. If you're not sold on RCTF within the first 6 weeks, you have zero obligation to continue. Simply shoot an email at least 7 days prior to the end of your kickstart ending to abby@rc-fit.com and let us know if that's the case.
For monthly memberships, to cancel/terminate a membership after their membership term, members must give RC Training & Fitness, LLC notice 30 days or more prior to the billing date which they wish to cancel.
Any unpaid dues or indebtedness incurred prior to the cancellation date must be paid in full.
You must notify us via email (abby@rc-fit.com) only, and you will receive a confirmation email back. Telephone, or verbal requests are not accepted. If you do not receive a response, RC Training & Fitness, LLC has not received your request.
Change of Membership Type: Can I change my membership type?
Members may change their membership type at any point. For example, a member may upgrade from a 2x a week to a 4x a week membership with no penalty.
Please email us at abby@rc-fit.com to make any changes to your membership. If you do not receive a response, we have not received your request.
